SC again reprimanded the High Court judge for a ‘absurd’ order to hear the case.

The Supreme Court has again been scheduled to settle the case again on 8 August, in the first week, it was observed. An Allahabad High Court Judge to pass the “absurd” order,

Justice JB Pardwala and R. A bench of Mahadevan reprimanded Justice Prashant Kumar, a High Court Judge, for “cutting a sorry figure for himself” and “jokes of justice”.

The Supreme Court was also ordered to pursue the apprehensions of the High Court judiciary.

“We are at the end of our Wits to understand what is wrong with the Indian judiciary at the High Court level. Many times we leave thinking whether such orders have been passed on some external ideas or it is ignorant ignorance of the law. Whatever it is, it is something unlike to pass such absurd and wrong orders.”

The apex court had taken a harsh exception to Justice Kumar, which was nothing wrong in a litigation, which was lodging a criminal case against a buyer in a purely civil dispute on the unpaid balance of money in a sales transaction.

The bench said that the High Court judge had not found anything wrong in allowing a criminal case for the ‘criminal violation of the trust’ to be registered in a civil dispute.

The bench further asked the Chief Justice of the High Court of Allahabad to remove the judicial Kumar from the criminal roster and did not assign any criminal case until he leaves the office.
